Virtual Law Campus (VLC) Of PTLBOnline legal education in India is still at the infancy stage. In fact, the concept of online education has not been accepted with full heart in India so far. Another area of concern is the academic nature of our educational system where there is no real choice between skills and degree. A blind race to acquire a degree would not bring any tangible benefits except unemployment and frustration. This is the reason why India must stress upon skill based education and trainings.

Skills based education and training can be effectively imparted if we adopt online education or e-learning methodology. This is more so in the legal education field that has mostly remained untouched by the use of information technology for educational purposes.

Perry4Law’s Techno Legal Base (PTLB) has been working in the direction of establishment and working of online legal education in India for long. Not only this, PTLB Virtual Campus is also providing many techno legal skills development, training and education courses in India and around the world through online education, distance learning and e-learning modes. The aim of these two initiatives and other educational projects of PTLB is to impart online legal education ranging from traditional fields to the most contemporary topics. For instance, PTLB has been managing online cyber law education in India for long. Cyber law is a contemporary legal area that requires techno legal expertise. There are very few cyber law education institutions in India and even lesser are cyber law experts in India. Thus, the demand for cyber law professionals is very great in India and other jurisdictions.

Similarly, areas like cyber security, cyber forensics, e-courts, online dispute resolution (ODR), e-discovery, etc also require qualitative educational institutions. The traditional universities or colleges are constrained by their own rules and courses but online education platforms are free to provide qualitative and customised techno legal courses.

PTLB is in the course of adding and introducing novel, qualitative and highly efficient training, skills development and education tools and technologies. We are also introducing some very unique and highly required techno legal and other courses that are not properly represented in present times. PTLB is also exploring tie ups and collaborations with universities, colleges and other online learning platforms in India and abroad.

Nevertheless India preferred the academic structure over skills oriented courses and trainings. As a result we have mass educated unemployed youth that has become a mammoth problem for our successive governments to manage. India was smart enough to realise that skills development is the need of the hour. The Congress government laid down the foundation for a robust skills development infrastructure in India and the BJP government is carrying forward the same to its logical end.

In the past the Indian government took some very significant steps in the direction of making skills development an essential part of the educational and training initiatives. The government had not only allowed private training and educational institutions to operate with full autonomy and liberty but it had also ensured that they provide qualitative and productive training and education.

In my personal opinion, it is high time for Indian Government to encourage online trainings and skills development providers of India. These institutions or individuals must be free from the shackles of regulatory approvals and recognitions as they must be solely judged for their quality and contribution that they possess for making Indian masses skilled and trained.

We have no set pattern or procedure for cyber crime investigation in India. In fact, a petition is already pending before the Supreme Court of India for prescribing regulations for effective investigation of cyber crimes in India.

The increasing numbers of financial frauds and cyber crimes in the corporate sector of India is a serious cause of concern. In the absence of adequate number of computer forensics professionals in India, there is negligible cyber crimes convictions in India.

Indian government has decided to give more powers to Serious Fraud Investigation Office (SFIO) of India to tackle such white collor crimes in India. Indian government is also planning to develop computer forensics skills in India. Perry4Law’s Techno Legal Base (PTLB) welcomes these efforts of Indian government as they are much needed in the present circumstances.

Recently, few banks were accused of engaging in money laundering exercises. The Reserve Bank of India (RBI) also found some aberrations at ICICI, HDFC and Axis Banks functioning and it has announced to take action against the guilty banks. While the banks have also initiated their own investigation but these private investigations may attract additional legal liabilities. Similarly, a forensics analysis of Nokia’s computers is also in process to ascertain whether they were used to download softwares in India.

Cases like these would increase in the future. Cyber forensic investigation solutions in India are needed to be developed. These solutions must have the capabilities and expertise to ascertain internet protocol (IP) addresses, data recovery, e-discovery, e-mails IP tracking, deep web analysis, IP address spoofing analysis, etc.

We also need to develop computer forensics best practices in India. The present approach of India regarding computer forensics is not proper. Similarly, the IP address should not be the sole criteria to arrest an accused. Recently, the Supreme Court of India has declared that a senior police officer’s permission is required for arresting a person for posting objectionable contents on social media websites.

Although this is a good step in the right direction yet there are many problems with our present cyber law and the same deserves an urgent repeal. Similarly, modernisation of law enforcement and parliamentary accountability of law enforcement and intelligence agencies of India is also required.

Right To Education Act Of India: Success Or Failure

PRAVEEN DALAL MANAGING PARTNER OF PERRY4LAW CEO PTLBIn this Guest Post, Praveen Dalal, managing partner of law firm Perry4Law and a Supreme Court Lawyer, is discussing about the implications of the Right to Education Act in India.

In Unni Krishnan v. State of Andhra Pradesh (1993) the Supreme Court of India held that Right to education is a Fundamental Right. Reacting to this judgment and similar judgements of Supreme Court of India, Article 21A of the Constitution, through Constitution (Eighty-Sixth Amendment) Act, 2002, was inserted into the Constitution of India.

Article 21 A provides that the State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine. Article 45 of the Constitution of India has also been reframed and substituted and it provides that the State shall endeavour to provide early childhood care and education for all children until they complete the age of six years.

In Article 51A of the Constitution, after clause (k) has been added that mandates that a parent or guardian has to provide opportunities for education to his child or, as the case may be, ward between the age of six and fourteen years.

The Right to Education Bill, 2005 was introduced to give effect to the Constitution (Eighty-Sixth) Amendment Act. The Right of Children to Free and Compulsory Education Act 2009 finally came into force on 1st April 2010.

The Constitution validity of the Act was challenged before the Supreme Court that upheld its Validity and dismissed a Review Petition. From here starts the real problem as the Act has now become Constitutionally Valid and subject to Constitutional Attack only when a Constitution Bench of Supreme Court hears the case again.

In my personal opinion, the Right to Education Act was drafted in haste and without many deliberations. The Act has also “Diluted” the “Protections” available under the Constitution of India.

For instance, the original Article 45 of the constitution provided that the State shall endeavour to provide, within a period of ten years from the commencement of this Constitution, for free and compulsory education for all children until they complete the age of fourteen years.

The Directive is very clear. There is no age slab of 6 to 14 years rather the Directive covers all Children even before 6 years. The Right to Education Act has unnecessarily diluted this Principle and has artificially created an age slab of 6 to 14 years.

Of course, the State is under an obligation to provide early childhood care and education for all children until they complete the age of six years under the reframed Article 45.  This would again create a conflict between The Right to Act, Article 21A, Article 45 and Article 51A (k).

The best example of this conflict is the Pre School Admissions Procedure that starts at the age of 4 in New Delhi. Various schools have framed their own “Point Criteria” that is going against the mandates of Article 21A, 45 and 51A (k).

If the State is under an Obligation, to provide early childhood care and education for all children until they complete the age of six years, the Pre School/Nursery admissions are clearly its obligation. Till now the State has failed to fulfill this obligation.

Further, by introducing the age slab of 6 to 14, all Inconsistencies, Violations and Corrupt Practices happening at the Pre School/Nursery Admission stage have also been “Ignored” by the State. This is encouraging the Schools to openly ask for “Donations” during Pre School/Nursery Admission Stage.

The Act is also discouraging filing cases and taking legal actions against Schools/Individuals that violate all the basic norms of Education and indulge in “Corrupt Practices”.

It seems the net result of the Right to Education Act is to give “Full Leverage” to Schools, imposing “Obligations” upon the Parents and “Abdicating” the Constitutional Duties on the part of the State.

Fortunately, the Delhi High Court is presently considering many of these aspects and I hope it would come up with some good “Solution” in this regard that was expected from the Supreme Court and Central Government and State Governments.

Meanwhile we have to ask ourselves a simple question. Do we really need such an Onerous, Biased and Burdensome Right to Education Act in India? Let the Readers and Delhi High Court decide.

The cyber security reflections of India in the year 2012 showed a poor state of affairs in India. We have no dedicated cyber security laws in India as on date. Indian critical infrastructures are vulnerable to cyber attacksand we must ensure sufficient cyber security for the same. In these circumstances, nothing is more important than having offensive and defensive cyber security capabilities of India.  The same cannot be acquired till we have techno legal expertise and skills development in India in this regard.
